Learn About Your Rights to Satellite Service

December 24th, 2012

Occasionally, rental properties or homeowners associations (HOAs) tell our customers they’re “not allowed” to have a satellite antenna. This is not always the case.

In fact, the Federal Communications Commission (FCC) created the Over-the-Air Reception Devices (OTARD) Rule to regulate and protect your choice of TV providers.

In most instances, you are allowed to have a DISH antenna provided you meet the following criteria:

  • The antenna is installed in an area that you have sole access to (such as a private balcony or deck).
  • The antenna’s placement does not extend into any common areas (such as walkways or gardens).

If you feel that you meet these minimum requirements or if you have questions regarding the OTARD Rule, contact the FCC at 1-888-CALL-FCC (225-5322) or visit the FCC’s page about the OTARD Rule. The FCC can determine whether or not your right to choose a TV provider is being unlawfully denied and help you resolve the issue.
